Blake Online Gallery Terms of Sale

Please read these terms carefully as payment for works constitutes acceptance of these terms and conditions

Payment

  • All prices for works are inclusive of GST if applicable. The listing will indicate which works include GST on the basis that the Artist is registered for GST.
  • The cost of freight is additional to the cost of the artworks and must be borne by the purchaser.
  • Payment will be accepted by Cheque (payable to The Blake Society Ltd), Mastercard and Visa.
  • The Blake will issue a receipt once payment in full is received.
  • The Blake must receive payment in full for each work before transport to the buyer is arranged.

Transport

  • The cost of freight will be additional to the cost of the work.
  • Transport and collection of the work should be arranged between the purchaser and the artist. Once payment for the work is received, the Blake will provide the purchaser with the artist contact details to arrange transport and
    collection.
  • For works bought by international purchasers, the cost will be finalised once consignments have been packed. The Blake Society will not be responsible for any customs charges for international deliveries. These costs will be covered by the purchaser of the work.

Returns and Refund

  • The Blake Society will refund the purchase price of a work if the buyer is not satisfied with the condition of the artwork or the accuracy of its presentation on the website. The buyer must notify the Blake Society within 7 working days. The work must be returned to the artist (address to be supplied) in its original condition. A photograph of the work will be taken prior to packing to ensure that it is in good order and condition before dispatch.
  • All costs associated with the return of a work must be borne by the purchaser.
  • The Blake Society will notify the purchaser via email of any refund, once the reason for the return of goods has been accepted and the artist has received the goods in the same order that they were shipped.
  • Please note a refund will not be given if the purchaser changes their mind on receipt of the work, which was accurately described and presented in the online gallery. If you have any doubt about a work, please contact The Blake Society to address any questions or concerns regarding representation.

Limitation of Liability
Unless otherwise stated, the information and services provided are provided “as is”, without warranties or representations of any kind. To the extent they cannot be excluded by law, the liability of The Blake Society shall be limited to the cost of the resupply of the information or services. The Blake Society shall not be liable for any consequential damages such as loss of profits, loss of wages, loss of enjoyment, property damage or stress or anxiety arising out of any negligence or non-performance or breach of contractual obligation in respect of any matter act or thing in relation to the online gallery, including but without limiting the generality of the foregoing, any late delivery of goods or services.
